1. Disclosure Regarding Background Investigation
SwapSitters (“the Company”) hereby advises you that, in connection with your application to use our platform as a [Sitter/Service Provider], we may obtain a consumer report (commonly known as a background check) and/or an investigative consumer report for purposes of evaluating your eligibility for platform access.
These reports may contain information regarding your character, general reputation, personal characteristics, and mode of living. They may involve the collection of information from federal, state, and local agencies, including but not limited to:
- Verification of your identity and Social Security number.
- Criminal history and sex offender registry records.
- Motor vehicle and driving records.
2. Colorado-Specific Protections (2026)
In accordance with Colorado Revised Statutes (§ 5-18-109 and § 24-72-706):
- Seven-Year Rule: We do not consider or report arrests, civil judgments, or non-conviction records that are more than seven (7) years old for users earning less than $75,000 annually.
- Clean Slate Act: We do not consider any records that have been automatically sealed or expunged by the State of Colorado.
- Individualized Assessment: If your report contains a conviction, we will conduct an individualized assessment of the offense’s relevance to the safety and requirements of the platform before making a decision.
Important Notice
While background checks are a vital safety measure, they are not a guarantee of future behavior. We encourage all members to utilize our additional safety tools, such as the “Meet & Greet” guidelines, reference checks, and community feedback systems, to make informed decisions about who they swap care with.
